Dismissed Possession of Heroin and Probation Violation

Outcome: Dismissed

Description: Client was arrested for possession of heroin while being the subject of an overdose call. Client was on probation and his probation officer asked the Court to impose a 2 year jail sentence. I filed a motion to dismiss the charge based on the new overdose immunity law. The motion was granted after some resistance from the judge. His probation was continued on the same terms, avoiding the 2 year jail sentence. Client walked out of court with me a free man.
