Suppressed Illegal Search Warrant on Felony Drug Distribution

Outcome: Suppressed/Dismissed

Description: The police executed a search warrant at my client’s house. They found 35 bags of heroin, over $600 in cash and a cell phone. They charged him with possession with intent to distribute heroin, a felony. However, upon review of the search warrant, it was executed on the 8th day, making the warrant stale. We filed a motion to suppress the warrant which was granted by a judge. The felony was dismissed.
