Dismissed – Assault and Battery on Family/Household Member

Our client was charged with Assault and Battery on a Family/Household Member. We decide to select a trial date to force the Government to prove the case beyond a reasonable doubt. On the day of trial, the Government was not ready for trial. We asked the case be dismissed for lack of prosecution and the judge agreed with our motion. Therefore, the judge dismissed the case.
