Dismissed – Assault and Battery on a Family/Household Member

August, 2019

Our client was charged with Assault and Battery on a Family or Household Member. We did our own investigation by hiring an investigator. Through that investigation, we were able to gather evidence for a self defense claim by getting prior court documents and interviewing the complaining witness. We marked the case down for trial. On the day of trial, the Commonwealth of Massachusetts was unable to go forward on the charge because they did not have enough evidence to prove the charge. As a result, we requested the judge dismiss the charge. Our motion was granted and the charge of Assault and Battery on a Family or Household Member was dismissed.
