Larceny Under $1200 – No Complaint Issued at Massachusetts Clerk Magistrate’s Hearing

Our client was issued a notice for a Clerk Magistrate’s Hearing in Massachusetts for Larceny Under $1,200, which is a criminal misdemeanor charge.

We presented an argument to the Clerk Magistrate with our client that a larceny did not happen because our client did not have an intent to steal. The alleged incident was actually an accident.

After presenting our argument by going through the facts, the clerk decided not to issue the complaint. Therefore, our client was able to avoid a criminal record and the criminal charge from issuing.
