Not Guilty – Operating Under the Influence of Drugs

Outcome: Not Guilty

Description: Client was stopped at a checkpoint, roadblock in Massachusetts. After allegedly “failing” the field sobriety tests, the client was charged with operating under the influence of drugs. Client was adamant he was not under the influence of drugs while he was driving. We challenged the roadblock as illegal under the 4th amendment. After a four-hour long evidentiary hearing with four police officer witnesses, the judge admitted it was a close call but decided it was a legal roadblock. Client decided to take the case to trial. After trial, client was found not guilty and was acquitted of the charges.
