Our client was accused of Operating on a Suspended license in Massachusetts, which is a criminal charge that has a potential jail sentence associated with it as a penalty. Our client was also charged with No Inspection Sticker which is a traffic violation in Massachusetts.

We went through the police reports and our client’s RMV driving history. We argued that our client did not know their license was suspended at the time they were caught driving. In order to prove someone is guilty of Operating on a Suspended License in Massachusetts the prosecution must prove beyond a reasonable doubt that the defendant or an agent of the defendant, such as a household member or employer, had received notice that their right to operate in Massachusetts had been or was about to be (suspended) (revoked).

Prior to the arraignment, we discussed the circumstances of the case with the prosecutor who agreed to dismiss the charges against our client.
