Operating a Phone While Driving – Dismissed

Our client was charged with Operating a Motor Vehicle while Using hand Held Wireless Communication – Cell Phone in violation of Rhode Island General laws 31-22-31(B), which is a traffic offense. The Police Department wanted our client to plead Guilty and receive a license suspension. We gathered our client’s cell phone records to show they were not using their phone at the time of the stop. We went before the judge and presented our arguments using the law and facts of the case. As a result of our arguments, the judge dismissed the ticket.
