Our client was accused of violating their probation. The Probation Department originally moved to have our client detained pending a Final Probation Violation Hearing. After arguments, the Judge denied the Probation Department’s request and the client was released from jail.
Our client was then scheduled for a Final Probation Violation Hearing. They were facing a potential sentence up to the maximum penalty of the crime they were on probation for. Our client exercised their right to a hearing and forced the Probation Department to prove by a preponderance of evidence that they indeed violated their probation.
At the hearing, the Probation Department testified and presented evidence. We presented our own evidence at the Probation Violation Hearing. After the hearing was concluded, the Judge found our client not to be in violation of their probation.
