No Probable Cause Found on OUI Charge

Our client received a summons in the mail for a Clerk Magistrate’s Hearing in Massachusetts. At this Hearing, the police need to demonstrate that there is probable cause to proceed on the charges. We made arguments that there was no probable cause as to the charge of Operating Under the Influence of Alcohol. After cross examining the police and making arguments to the Clerk Magistrate, no probable cause was found as to the charge of Operating Under the Influence of Alcohol. Therefore, no charge of Operating Under the Influence of Alcohol was brought against our client.
