No Complaint Issued at Massachusetts Clerk Magistrate’s Hearing for Negligent Operation of a Motor Vehicle

January, 2021

Our client was issued a notice for a Clerk Magistrate’s Hearing in Massachusetts for Negligent Operation of a Motor Vehicle, a criminal charge, and Speeding, a civil motor vehicle infraction.

Our client had explanations for why they were driving a certain way. We presented these defenses to the Clerk Magistrate as mitigating circumstances to why they were driving a certain way.

We presented an argument to the Magistrate and asked them to take into consideration all of the circumstances going on. The Magistrate took into account all of the facts of what happened. As a result, the Magistrate did not issue a criminal complaint for theNegligent Operation of a Motor Vehicle. This meant our client did not get arraigned on the charge and avoided a criminal record.
