Dismissed – Strangulation and Domestic Assault and Battery

Our client was charged with one count of Strangulation and one count of Assault and Battery on a Family/Household Member in Massachusetts. This is a felony count along with a misdemeanor count. Both charges carried a potential jail sentence of 2 and a half years on each count.

After going over the allegations with our client, we decided to do our own investigation, independent of the police investigation. We had information to show that this event never happened. We shared this information with the prosecution.

As a result, we selected a trial date. On the trial date, the prosecution could not go forward on the charges because they did not have enough evidence and information to prove their case. Therefore, all charges were dismissed.
