Dismissed – False Police Report and Witness Intimidation

Our client was charged with Filing a False Police Report and Witness Intimidation (Misleading the Police), which is a felony. Our client went into the police originally to get a restraining order on somebody who was sending them threatening and harassing text messages. Our client detailed the interactions and cited the text messages in their affidavit to police.

Later on, the police believed that she was lying based on text messages the other person gave to the police. The police did not analyze either person’s phone and decided to take out charges on our client.

We hired a cellular forensics investigator to analyze our client’s phone. This is known as an expert witness. The cellular forensics investigator was able to generate a report of all the text messages the two parties sent to each other. This report included the text messages our client referenced in her affidavit to the police. In addition, it had multiple threatening and harassing messages directed to our client from the other person. Therefore, it proved our client was innocent of the charges they were accused of.

On the day of trial, the prosecution did not have enough evidence to proceed against our client. Therefore, both charges were dismissed.
