Description: Client was arrested on a warrant. The police then asked her about another potential new crime, Larceny over $250, while she was in handcuffs, in the back of a cruiser and had not been read her rights. Client made statements as a result of their questioning. She was charged with larceny over $250. After an evidentiary hearing with the police officer testifying, the judge ruled my client’s statements were to be suppressed because she was not read her rights. We took the case to trial, and the felony was dismissed on the day of trial.
