Description: Police conducted a search of a motor vehicle. The police found eight bags of marijuana individually wrapped. They charged my client with possession with intent to distribute marijuana. I filed a motion to dismiss the charge based on a lack of probable cause for intent to distribute. After a hearing, the motion was allowed by a judge. The judge found no probable cause for distribution and instead only for possession (a civil offense). The criminal charges were dismissed.
