Not Guilty – Improper Storage of a Firearm and Possession of a Silencer (Felony)

Outcome: Not Guilty

Description: A police SWAT team executed a search warrant looking for my client’s brother and stolen items, neither of which were at my client’s house. The SWAT team asked my client and others in the house to come outside, and they complied. The SWAT team went into the house and found properly locked firearms along with three unsecured firearms and a “homemade silencer.” Client was charged with three counts of improper storage of a firearm and possession of a silencer (felony). Client was a hunter and was getting ready to go hunting which is why the guns were taken out. We went to trial, and two witnesses testified on his behalf. Client was found not guilty of all three counts of improper storage of a firearm. Prior to trial, we filed a motion to dismiss the possession of a silencer charge which was granted.
