Dismissed – Unlawfully Visiting a Common Nuisance

A common nuisance is any store, shop, warehouse, building, vehicle, aircraft, vessel, or any place which is used for the unlawful sale, use, or keeping of a controlled substance. It is against the law in Rhode Island to knowingly visit a common nuisance for the purpose of using or taking in any manner any controlled substance.

Our client was charged with Unlawfully Visiting a Common Nuisance in violation of Rhode Island General Laws. After much discussion with the prosecutor, we were able to show that our client had no knowledge that drugs were being sold, used or kept in a building. The prosecutor agreed with our argument and dismissed the case.
