Dismissed – Possession of Marijuana 3rd Offense

Our client was charged with third offense possession of marijuana (less than one ounce) in Rhode Island within eighteen (18) months of their first offense. This is a misdemeanor criminal offense which has a penalty of possible incarceration for up to thirty (30) days and a fine from $200 to $500. It can also lead to having a criminal record.

After negotiating with the prosecutor in the case, we were able to convince the prosecutor to dismiss the charge. As a result, our client did not have a criminal record or face the punishments under the law. We were able to file a Motion to Seal the charge, which was allowed. Therefore, our client’s record was sealed after the dismissal.
