Trial Date: Pretrial Probation (Deferred Dismissal)

Our client was charged with assault and battery in Massachusetts stemming from an altercation at a store. We hired an investigator and did our own investigation into what happened. We set the case down for trial and were prepared to argue self defense and defense of another, both affirmative defenses in the Commonwealth of Massachusetts. As we were set to bring out the jury, the Commonwealth changed their offer to Pretrial Probation. Pretrial Probation is essentially a delayed dismissal. If you stay out of trouble for a certain amount of time, the case is dismissed. You are still considered not guilty – so you don’t have to admit to any charges. If for some reason you pick up new charges, the case is returned to the trial list. It is not a probation violation. Our client accepted this disposition.
