Dismissed – Malicious Destruction of Property and Disturbing the Peace

Our client was charged with Malicious Destruction of Property and Disturbing the Peace. We decided to do our own investigation into the charges. We hired an investigator who spoke to the witnesses involved in the case. We learned that the main witness in the case said the whole incident was an accident. Therefore, it could not be Malicious Destruction of Property. In order to prove Malicious Destruction of Property, the Government has to show that a person willfully and maliciously destroyed property. This means it has to be intentional and done with malice. In other words, it has to be more than an accident.

We selected a trial date on the matter. On the day of trial, the Government did not have enough evidence to proceed with the trial against our client. Therefore, the case was dismissed.
