Dismissed – Assault with a Dangerous Weapon Person Over 60; Assault and Battery on +60/Disabled with Injury; Assault and Battery

December, 2019

We are pleased to announce the dismissal of our client’s case. Our client was charged with Assault with a Dangerous Weapon Person Over 60; Assault and Battery on +60/Disabled with Injury; and Assault and Battery. He was facing two felony counts along with a misdemeanor count. All charges carried a potential jail sentence of 2 and a half years on each count.

After going over the allegations with our client, we decided to do our own investigation, independent of the police investigation. We hired a private investigator who was able to interview witnesses in the case. This information helped to show our client did not commit any of these offenses. Instead we had evidence that showed it was only a verbal argument. You can read more about potential defense here .

We presented this information to the prosecution and selected a trial date. On the trial date, the prosecution could not go forward on the charges because they did not have enough evidence and information to prove their case. Therefore, all charges were dismissed.
