Operating a Motor Vehicle While Using Hand-Held Wireless Communication Device Dismissed in Rhode Island

Our client was driving their car and was accused of using their telephone with operating a motor vehicle. Rhode Island General Law 31-22-31 states no person shall operate a motor vehicle while using a hand-held device while the vehicle is in motion. It is a traffic violation that can result in a $100 fine, a conviction on your driving record and a potential license suspension. This can cause an increase in your insurance premiums.
We discussed the situation with our client and performed our own internal investigation into the matter. As a result of our legal research and the circumstances of the case, we argued our client fell under an exception in the law. After a hearing, the case was dismissed, which avoided this charge from going on our client's driving record.
