Dismissed - Assault and Battery on Family/Household Member

Our client was charged with Assault and Battery on a Family/Household Member in Massachusetts on their spouse. This is a misdemeanor domestic violence crime. If convicted, a person would have to do batterer's intervention classes along with facing potential jail time, possible probation, fines and fees, a potential criminal conviction and a criminal record.
It was learned throughout representing this client that their spouse wished to assert a spousal privilege. As a result of asserting the spousal privilege on the record in front of the judge, the prosecution was unable to proceed.
As a result, we made a Motion to Dismiss the criminal charge. The Motion was granted and the charge was dismissed.
